A wearable can be convenient for its owner while turning everybody nearby into unregistered input.
Australia’s Privacy Commissioner has warned that the next wave of smart glasses changes the privacy question from where cameras are installed to who may be recording at any moment. Her August 2026 analysis points to devices that capture images, video and sound in ordinary social spaces, often without a bystander knowing that collection has begun.
The article is regulatory commentary, not an enforcement finding against a particular product. It matters because the person who bought the glasses is only one participant in the system. Everyone in view may become source material for storage, transcription, recognition or an AI assistant.
Follow the capture pipeline
The privacy risk depends on the technical path. A device may process a command locally, send audio through a companion phone, upload media to a vendor account, create biometric templates or retain data for product improvement and model training. Those are different uses and should not be collapsed into a single camera permission shown only to the owner.
A useful product disclosure should say when the sensor is active, what is processed on-device, what leaves it, where it is stored, how long it remains and whether it trains a model. A visible recording indicator must be difficult to disable, and cloud features should minimise bystander data before upload rather than promise to delete it later.
The law has a gap shaped like the bystander
The Commissioner notes that Australia’s Privacy Act generally applies to businesses and government agencies, not individuals. When a technology company receives and stores personal information from a wearable, it must consider privacy-law duties—including how people are notified and how consent could work for facial recognition. Purely personal, on-device collection may sit outside that regime.
Other remedies may apply, including Australia’s tort for serious invasions of privacy in sufficiently serious cases. But a product should not depend on a harmed bystander finding the correct legal route. The safer design gives the people around the device legible signals and keeps the most sensitive processing local, limited and reversible.
